We had a good Board of Directors meeting January 9, 2010 10:AM  There were come complications.  It was “COLD”.  The Ball Room was too cold for the meeting.  Thanks to the coffee drinkers, they had been in the restaurant for their morning coffee.  It was not “warm”, but it was far better than the Ball Room.  So, everyone moved into the restaurant, and a good number was present.  All of the Board members were present except Vickey Cantu who was absent with excuse. Some things the Board began with in discussion and review, are things all need to be aware of, and from this review, it led into the first item on the Agenda.

PRIMARY BOARD RESPONSIBILITIES
1. Oversee the financial affairs – Collection of fees – budget – etc.
2. Maintain 24/7 entrance gate
3. Maintain roads
4. Oversee members abide by the Bylaws and Deed Restrictions
These are the areas the Board is giving attention to and pressing that they might be accomplished.

COLLECTION OF FEES – The first letter sent out by our attorney went to 19 delinquent members.  13 have paid the delinquent amount plus various fees, 2 have filed bankruptcy, I has been foreclosed  by his mortgage company, and 2 appear to have more taxes and bills due than it would be profitable for NHOA to foreclose.  Only 1 remains as a possible foreclosure February 2, 2010.  The amount collected from these 13, plus some other members who were delinquent, but became aware of the Board’s action toward collecting, comes to $42,000+ in fees from past years.  The next letter from the attorney will be mailed in the next 7-10 days.  Many delinquent members will be affected by this action. The numbers and amount is staggering.  With the 2010 fees  now due:

17 are delinquent over $2,000
20 are delinquent over $1,500
Over 60 are delinquent over $1,000

If you are delinquent, please go to the NHOA Office and make arrangement for the payment of your past due fees.  Once the collection process begins, there will be additional costs. If all members become current, and stay current, the Board will be more able to fulfill their responsibilities.

VIOLATIONS – of Bylaws and Deed Restrictions.  This has been covered in earlier updates, but it was an issue discussed at the Board Meeting.  With just this matter being discussed, some good things are already happening.  Two abandoned cars have been hauled off the week of January 10.  The Board is discussing imposing fines on violations that are not quickly remedied.  This will be on the Agenda for the next Board Meeting.

ENTRANCE GATE – There will be a joint meeting of the Finance Committee and the Gate Committee during January.  They will review the need for the entry gate, and consider the budget with the gate needs included, in the light of past due funds being collected. The Board will have this on the February Agenda.

ROADS – This is an area that has the interest of all members, as well as the Boards.  Some road base can be graded in badly damaged areas  caused by the winter, and pot holes filled, etc.  However, serious Road Rebuilding, etc. will have to wait for warmer weather.  With collections coming in, and the Road Rebuilding Fund increasing, much needed road work will be done this Spring and Summer.  Two areas the Board discussed and must be considered are “sealing” Fairway Drive, and one application of “chip and seal” on Nocona Drive.  Fairway Drive should have been sealed a year age or more.  If we fail to seal the road in time, the damage resulting will require more than sealing.  Likewise,  Nocona Drive has taken a beating this winter, and if not given attention soon, our huge investment in this most important traffic area will require a total rebuilding. The Road issue will be another item on our next Agenda.

CLEAN UP – We have called attention to the “eyesores” around our community.   A considerable amount of clean up has already taken place, and others are working on it.  We plan to use March as “CLEAN UP MONTH”  There will be a large dumpster near the Maintenance building for all members to use.  Everyone is encourage to use this time to get their property in a cleaned up status.   Following the clean up month, the Board will begin issuing notices that if properties are not removed from the “eyesore” status, the work will be done, and the member charged with the cost.

GENERAL – So many positive things are taking place, the Board simply wants to commend all who are involved,  and beginning to take pride in seeing things go forward.

The next Board Meeting will be February 13, 2010 10:AM.  We plan for it to be in the Ball Room at the Club House.  If this changes, you will be notified.

CLEAN UP - Clean up and road repairs  is progressing in several areas.  Several request have come in for road repair, and workers have responded.  Clean up on a number of lots is underway.  Some members are removing debris from their lots, and NHOA workers are clearing some areas.  We plan for this to be an ongoing work.

COLLECTION OF FEES - As stated in an earlier update, there is an extremely large amount of fees owned from 2-3-4 years past.  An attorney has been enlisted to pursue collection of these fees.  We must get our fees current, and then keep them current for Nocona Hills to operate at the standard of our our Bylaws and rules.  There will soon be another group of demand letters from the attorney.  As this process begins, the Board then follows the counsel of the attorney.  As we have numerous times, we appeal now more than ever, bring your Maintenance Fees and Road Fees up to date.

REPORT OF JOINT MEETING OF GATE AND FINANCE COMMITTEES - These two committees met Monday, November 2nd in the home of Jim and Ann Fitts.  There was active discussions, and everyone expressed their feelings.  The two main issues of these committees are the operation of the entry gate, and the budget for our new fiscal year 2010.  These issues are definitely related.  It is reality, with our maintenance fees at $200 a year, we cannot budget in the entry gate.  This yearly fee, makes the monthly amount, for both the Maintenance Fee and the Road Fee $33.34.  With an increase of only $6.67 per month, up to $40 a month, we will be able to budget in the entry gate.

With the collections coming in, and the small increase in the fees, we can operate 2010 in the black.  This small increase will be reflected in the changes to be made in the Bylaws.  The Bylaws are being prepared to be sent out to all members for a vote in the changes.  The majority of the changes has to do with dates, due to the change in our fiscal year. The change of the Maintenance Fee, along with the change of the water availability fee, from $48 to current $68 will bring the fees to be voted.

We are  hopeful the Bylaw changes can be mailed in time for the vote by our December 5th Membership and Board Meeting.  The Bylaws require the changes be sent out 20 days before the vote.  With a positive vote on all changes, the two committees will meet the 1st or 2nd week in January.  With collections continuing, and the new budget adopted, it will be determined to begin operating the entry gate.  With a year operating on a strict budget, we will know what our receipts must be to operate Nocona Hills properly.

WINTER WORK - During the Winter months it is not likely we can do much in the way of Road Rebuilding, though we will continue repairs as necessary.  With the road funds on hand, and the collections being made, we will have a sizeable fund to do some road rebuilding in the Spring.  Things are definitely looking up, and we want everyone to take pride in the betterment of our community.

One of the complaints, and a very realized need, is the matter of communication.  One of the main problems is what means can be used.  With the cost of postage, the regular mail has become very expensive.  Even hard copy printing for pick up, and posting in various places, will not reach all the owners.  Email appears to be the best choice.  We realize not everyone uses internet and email, though more and more are beginning to use this service.  So, with this email, we hope to began a means of providing information of what the Board of Directors is doing, working on, and planning for the future.  When we say the "Board of Directors" their extension is the office, operational manager, employed workers and all the committees. 

At the last Membership and Board Meeting, several observations were made.  The development is looking great, with a lot of mowing along the roadways, and safety improved with the clearing and mowing at many corners.  Mention was also made of the Road Rebuilding accomplished on Rivercreast Drive and Diamond Oaks Drive.  Work is continuing on road repair and filling pot holes.  This need is vast and the workers may not be aware os some areas.  When there is a urgent need, members are encouraged to come by the office and fill out a work order.

All of the new committees have , and some very positive directions are being discussed and recommended.  All of the committees and those serving on them are listed in the web site "noconahillsownersassociation.com".

THE ARCHITECTUAL COMMITTEE met and discussed a number of issues.  One serious matter is some members are in violation of our restrictions as they have not made an application for an ACC permit for work that requires a permit.  Any improvement, addition, or even a shed, there must be an ACC approval.  Application forms are available at the office.  The Committee has three recommendations that will be presented to the Board. These will be discussed at the next meeting.

THE GATE COMMITTEE met and reviewed the status of the entry gate over a period of time.  There was a strong feeling for the future development of Nocona Hills, and to fulfill the responsibility of the Board, and to comply with our Bylaws, the entry gate needs to be put in operation as soon as possible.
(*Please realize, these few words concerning all the committees are greatly condensed.  All of the committee meetings lasted 2 -  3 hours.)

THE FINANCE COMMITTEE has met twice.  he first meeting was at the NHOA office.  Since many thoughts and figures were presented for the first time, it was obvious there would need to be time to review and study all the figures.  The two major issues to work on is the operation of the entry gate and the Budget for 2010.  The second meeting met in the home of Jack and Joyce Seay.  It was decided that we should have a joint meeting of the Gate Committee and the Finance Committee. After this joint meeting, it is likely that we will have a bried report.

COLLECTION OF MAINTENANCE FEES AND ROAD FEES - Many members have been lax in payment of their fees, and some are behind several years.  NHOA cannot operate and have the standard of community it has determined to have without the prescribed fees being kept current.  Bills have been sent, and pleas made, but still the response has been small.  An attorney have been enlisted to pursue the collection of fees in arrears.  This is not the preferred choice, but without the fees being paid, we cannot operate the gate, rebuild the roads, keep areas mowed, keep up the campgrounds, boat areas, patch road, or even properly maintain the office.  With all fees in arears being paid, and members keeping current with their fees, then a workable budget can be maintained.

It was thought in the meeting in September that we would have a called meeting before the meeting in December, but it appears there will be a rush to have everything ready for the December 5th meeting.  With our changing the fiscal year from August 1 - July 31 to the calendar year January 1 - December 31, changes must be made in our Bylaws.  Bylaw changes must be voted on, and sent out 20  days before the date of the vote.  Time is short, but the Bylaw changes need to be voted on at the December 5th meeting.  Important issues will be discussed and acted on in the December 5th meeting.   An agenda will be prepared and posted before the meting.

This is a brief report of things taking place in Nocona Hills by those in various positions, and the desire to see our community move forward in a positive manner.
